Universal Credits Complaint
Part 1 of 2
Emma: I have asked Stuart to help me due to the latest
letter I received from Victoria (UCD579_Emma_Goode) regarding her latest
decision about my capability of Work, and me feeling I have not been heard
fairly.
Emma: This will be posted on both mine and Stuarts Universal
Credits accounts.
Stuart: please respond in kind to any question we raise, and
if you are not sure what we are asking or saying then please let us know thank
you.
Stuart: after 5 working days with no response to Emma’s
grievances, we decided together to take this next step.
Emma: I have uploaded my latest sick note dated from
22/12/2021 to 31/01/2022. I will be continuing to upload these every time I get
one.
Emma: I know that the
GP Mr Mohammed Naiwaz has lied about the points he put in the medical Report.
Emma: I have noticed that you have just copied and paste
from the medical report to the assessment (UCD584 Emma Goode).
Emma: I do believe that you have taken the GPs word over
mine.
Emma: I do want a second opinion on everything that I have
sent, Victoria comments and the GPs medical report.
Emma: I also still give you full consent to come over to my
house and see what I am like day by day because I still don’t know how you can
assess someone just by a telephone conversation and not see their situation at
home.
Emma: Have you received all the paperwork and the feedback
that you have requested? We sent it through the post first class recorded
delivery on Tuesday 14th December 2021. Can I please have a reply to this? I
did take it in to Stephen but he said he did not know who to give it to.
Emma: I have sent you everything twice about my condition
and situation. And yet you still think that I am capable to walk to the job
centre for a meeting or go on training courses. I cannot walk at all.

Emma: If you still want me to attend these meetings at the
job centre then you will need to provide a wheelchair for me. Stuart is more
than happy to come pick one up, bring it home and take me to the meeting.
Emma: I am willing to come to the meetings but not without a
use of a wheelchair. Last time I walked and it was extremely hard and painful
for me. I had to stop twice walking back home because of the pain I was in from
all the walking. I also spent the next 3 days in bed suffering in pain from it
more than usual.
Stuart: I will word this differently to Emma. We both want
to show WILLING, and will do anything to honour all your requests, but Emma
walking all the way to your office will cause me concern for her safety and
wellbeing, and I am begging you not to do this. Instead, if there is someone or
somewhere in Redditch Town Centre that will hire us a wheelchair, I will gladly
go and get it, pay for the hire, make sure emma gets to your requested
appointments, and will get her back safely and responsibly. I did consider dial
a ride, but I don’t know if they can get close enough to your office. If there
are other options please let us know. If you however insist on her walking
there, I will have no other option but to seek outside legal advice. I feel she
is not fit to walk to your office.
Stuart: I believe that Mr Mohammed Naiwaz has lied and made
up evidence and information.
Stuart: As per a Licensed GP’s oath to the patient I now
believe the GP should be reported or investigated by the relevant regulatory
authorities, as I believe a gross error of judgement as taken place, possibly
worse.
Stuart: I am now requesting a formal complaint procedure by
universal credits to do with why Victoria or the gp or UC didn’t to reply or
answer any of Emma’s concerns or grievances in her info regarding the GP
medical Report and the assessment.
Stuart: I also believe Victoria based her new assessment on
the same gps info, and I am again informing you I believe some of it to be made
up and lies.
Stuart: how do we start an investigation or formal complaint
please? Who do we talk to or go to?
Stuart: who else did the gp speak to regarding Emma’s
condition? Please supply notes or minutes, statements, recordings, or whatever
info you can.
Stuart: we should be reviewed again, by a competent and
honest gp, with a renewed telephone call with Emma, and me there if you so
wish. But I will only involve myself now by invitation.
Stuart: we have requested help from home help from Worcester
County Council help, to help us with john at school, and Emma’s ongoing
condition, and they will be coming over on Wednesday 5th January 2022 at 10am.
Stuart: I would like to know if we are entitled to legal aid
and where do I have to go online to get more info. I have come to the
conclusion we may need some legal assistance in the treatment of Emma’s
condition going forward.

2021 12 14 Note to Universal Credit

Added to the paperwork after seeing the Jobcentre.
Following the request from Victoria at the Lowestoft
Service Centre. I printed out and brought in all documents and letter for
Universal Credits. When I got to my meeting today (Tuesday 14th
December 2021 at 9.40am) I was told that they did not know what to do with the
paperwork and can I instead email it all over.
Below is a copy of what Victoria sent to me on my
Journal. She sent it on Tuesday 7th December 2021 at 3.11pm.
I got outside and told my partner about this and he
was not happy at all that we spent all night last night going through all the
paperwork and printing out the paperwork and wasting pieces of paper and
cartridge (my partner had to change the cartridge over as the other one ran
out) on stuff the jobcentre did not want in the end. We are now going to send
all of the paperwork through the post by recorded delivery and also email it
all over to you as well. The paperwork will be posted before this message
appears on UC journal.
I would also like to add that I did not see the point in the meeting if it was just to put a face to a name and not take my paperwork you asked for. I had to take 2 lots of tablets before I came to the meeting and now I am home in excruciating crippling stabbing pain again.

UC Medical Assesment Feedback

On 30th November 2021 I received a copy of your
documentation about how you have come to the decision that I am able to go back
to work. I have also received a copy of my medical report made by Mr Mohammed
Naiwaz on the telephone conversation we had on the 27th August 2021.
You stated that all of the information you looked at was
based on the Work Capability Assessment telephone conversation I had with Mr
Mohammed Naiwaz on 27th August 2021 and any other information, facts and
evidence you had. I would like to inform you that some of the information you
was given from that telephone conversation on 27th August 2021 by Mr Mohammed
Naiwaz was incorrect and not what I said at all.
Below is my notes to your decision and the reason on why
I think you have made the wrong decision thinking that I am able to go back to
work in the condition I am in at this present time.
You stated and I quote:
"You will go for a walk locally to get out once a
week. You walk at a slow pace using a crutch. You will walk for 10 minutes and
then rest for around a minute due to abdominal discomfort. You will then walk
again for a further 10 minutes."
This is completely false and my partner agrees with me. I
have never said that I go out for a local walk once a week. I cannot go for a
walk anywhere and I do not go out once a week. I actually do not go out at all.
I always stay in. I never go to places where there is a lot of walking involved
e.g. town centers. I only go to places where there are plenty of seats like a
play center. In fact my meeting on Tuesday 14th December 2021,
9.40am at the Job Centre in the Kingfisher Shopping center will be my first
long walk since October last year when I walked with my partner to take our son
to Nursery. I got halfway down there and I had to turn round and come back home
as I couldn’t finish the walk due to suffering so much pain in my abdomen. My
partner said to me later on that day that if I ever decided to walk to the
Nursery or the school again he would refuse to come with me.
When I do have to go out I ask my mother-in-law to drive
me. I walk across the road from my house to get into her car. I struggle
sometimes to even sit in her car as I am in pain from just walking across the
road. If my mother-in-law cannot take us to places we then have to call for a
taxi, even if it is just to go down the road to school. The one time in the
last year we went to our friend marks house on a Saturday night we had to get
my mother-in-law to come and pick us up and bring us back home virtually door
to door.
My partner always the one who goes out to town to get my
Tramadol Prescription from the chemist. He also goes and gets the gas and
electric and all other essential’s we need e.g. toiletries.
You stated and I quote:
"They were out for several hours"
This is completely false and my partner agrees with me.
When I do go out it is always with my mother-in-law in her car and my son and
we go to the play center and the most we are out is 2-3 hours top. If I have to
go to the school for a meeting I always go with my partner and we have to get a
taxi to take us down there and to bring us back and the most we are out for is
half an hour to 45 minutes tops. When we do go to our friend’s house on a
Saturday night we are only there for 3 hours and when we are at there I am
constantly sitting on his sofa resting with my hot water bottle. Every time I
do go out anywhere I always have to take a Tramadol and Paracetamol before I even
leave the house and I am always taking my tablets with me. Every time I come
back home from being out I am straight back to my bed resting and taking
tablets as I suffer so much pain. My partner also has to do my hot water bottle
as soon as we come home.
You stated and I quote:
"You will take your time using the stairs as this
can give you some abdominal discomfort. You use the hand rail and can manage
the whole flight without stops"
I always have to take my time when I am walking up and
down the stairs as I am in constant pain in my right side abdomen. When I am
walking down the stairs I am always using the hand rail, and my crutch taking
the stairs one step at time. On the way back up I am always holding on to the
wall and using my crutch and again taking one step at time. When I am going up
or down the stairs I do sometimes have to stop halfway as I am always suffering
with excruciating stabbing pains in my right side abdomen. But I always use my
crutch.
You stated and I quote:
"You are able to get out of bed independently."
This is true but I would also like to add that I do I
have trouble getting out of bed and I have to hold on to the arm rest that my
partner had bolted on to the side of the bed to help me get out of bed.
You stated and I quote:
"You will take pain killers when you wake up in the
morning"
I always have to take a Tramadol and a Paracetamol within
the first half an hour of waking up every morning because I always wake up in
excoriating pain all across my abdomen. I have also lately noticed that I am
suffering more and more pain in my right side abdomen when I wake up in the
morning.
You stated and I quote:
"You will use the bathroom and clean your teeth
every day. You will use the toilet. You no longer need to use a jug to empty
your bladder. You will have a bath twice a week. You are able to get in out of
the bath tub independently."
This is completely false and my partner agrees with me.
My partner believes this person may be actually making things up now. The times
I use the bathroom is always to have a bowel movement, have a bath, or to empty
my bladder. I would like to state though that I have a bath at least once a
week as I suffer so much pain and it is very difficult for me to get in and out
of the bath all the time. When I do have a bath I always have to hold to the
side of the bath and the hand rail my partner put up on the wall. Every morning
my partner has a shower and when he dries himself he uses a terry towel which
he then gives to me when it is damp for me to use to wipe myself down with to
clean the main parts of my body. I then put tea tree oil under my armpits to
stop them smelling. I would like to state that I have said this from the
beginning and it has never changed. I do not shower anymore as I cannot stand
for so long in the bath. It is very rare
that I will stand at the bathroom sink to brush my teeth. I do not stand at the
sink every day. When I do want to brush my teeth my partner always brings the
stuff (toothbrush, toothpaste, cup of water and a jug for me to spit in) to me
in bed and he will sit on the edge of the bed till I have finished brushing my
teeth and then put the things away for me and get rid of the water. I have
never said that I have stopped using my pee jug. I constantly use it. I use it
every morning when I wake up. I use the pee jug throughout the day if I really
need to but definitely when the pains is really bad and I cannot walk to the
bathroom which is right next door to my bedroom. I also use it throughout the
night when I wake up for a pee. My partner always empties my pee jug (Morning
day and night). My partner has just said he honestly cannot remember a day when
he didn’t have to empty the pee jug so yet again, his comments is not true.
Sometimes, I have to get my partner to come and help me
put on or pull up my knickers and trousers as I just can’t bend over.
You stated and I quote:
"You will help with house work when you can. You
will help with the washing up, putting the dish away, and wiping surfaces. You
will do this several times a week."
I have never said that I do the housework several times a
week. If I did do that it will literally cripple me forever because of all the
extreme excruciating crippling stabbing pains I suffer with all the time
throughout the day. It is very rare I do the housework. My partner does it all
by himself all the time, every day. If I do some of the housework, I probably
do it for about 5 minutes then I have to stop and my partner has to take over (like
putting dishes in the sink and leaving them for my partner to do) as I always
suffer in excruciating pain afterwards. I always find it difficult to get
around the house. I cannot stand for more than 5 minutes. I cannot bend over or
kneel down at all anymore. When my mother-in-law comes over with our shopping
it is always my partner who brings it in from her car and puts it all away. That
is one way she helps us. My partner also does all the preparing, cooking and
serving our meals. I am rarely in the kitchen helping out because I can only
last for 5 minutes and I'm back to resting in bed with my hot water bottle and
taking tablets due to the excruciating stabbing pains I suffer from it all.
You stated and I quote:
"You will make yourself a cup of tea throughout the
day. You are able to lift a 1 litre bottle of milk. You will make a hot drink
for your partner also."
I have never said that I make myself a cup of tea
throughout the day. I am rarely in the kitchen making myself or my partner a
hot drink. My partner makes us a hot drink all the time throughout the day and
brings mine up to me in bed. I probably make a hot drink maybe twice a week
that it. I cannot even bend over in the fridge to get the milk out. My partner
always leave the milk out on the side throughout the day just in case.
You stated and I quote:
"You will cross stitch in your spare time and enjoys
this. You will sit and do this for 2-3 hours at a time without having to
stand"
I am constantly in bed resting throughout the day when I
do my cross stitching. I spend about 7-8 hours a day doing this. I also cross
stitch because one I do enjoy it but also it keeps my mind off the pain and
stops me being bored while I am in bed all day every day, and it’s all I can do
at the moment. I do not sit and cross stitch.
You stated at the end of your document that the decision
was made by using the following regulations:
Regulation 40 of the Universal Credit, Personal
Independence Payment, Jobseeker's Allowance and Employment and Support
Allowance (Decisions and Appeals). Universal Credit Regulations Schedules 6, 7,
8 &9.
I would like to know what this is and I would like a copy
of your Universal Credits Regulations please thank you.
Below is the notes I made from going through and reading
my medical report:
Please can you tell me how you can make a medical
diagnose from just a telephone conversation.
I would like to request a second opinion on what Mr
Mohammed Naiwaz has put in his medical report to you. My partner has said he
will definitely be responding as well to this if my request is refused, as my
partner believes this person was making some things up, perhaps even avoiding
the truth.
No one has physically come out to my house and assessed
me properly or witnessed what I have to go through all day every day. I have
already given you my full consent to come to my house for the day and assesse
me, examine me and actually witness my day to day living. You have no idea on
what it is like for me day in and day out. I mean you literally cannot just go
by what a Medical Practitioner has written down on his medical report without
even seeing me. I am constantly resting in bed. I am bed bound all day every
day. I am constantly using my hot water bottle and taking tablets.
In the Medical Report it states the following:
Medication:
Ibuprofen (anti-inflammatory painkiller) taken as
required every day 200mg dosage once a day
Paracetamol (for pain relief) taken as required every day
at 1g dosage three times a day.
Tramadol (for pain relief) taken as required every day at
50mg dosage three times a day.
I am taking Ibuprofen twice a day. Tramadol and
Paracetamol at least 4-5 times a day sometimes 6. If I am having a good day I
am taking Tramadol and Paracetamol 2-3 times. But this is becoming very rare
now.
Medical Report states and I quote:
"She had a coil inserted at the time of the
operation. She feels the operation did help but feels her pain is getting worse
again over the last 6 weeks."
I had my operation on 21st June 2021 to remove all of my
Endometriosis. The coil was inserted and definitely helped with the bleeding. I
no long have periods. I do not think that the operation has helped with my
pains at all. In fact since having the operation I have gotten a lot worse. Me
and my partner both believe that I am now back to the way I was before I had my
first operation back in September 2020 where I had a biopsy done to confirm
that it is Endometriosis. My partner has always suspected there is a physical
injury inside me somewhere, and I am beginning to believe that as well now.
Medical Report states and I quote:
"She is taking pain killers which helps to reduce
the pain a little."
I am taking at least three Tramadol’s before the pain is
bearable now.
Medical Report states and I quote:
"She reports the pain is worse when she opens her
bowels or has a full bladder"
This is false I did not say that at all. I am in
excruciating crippling stabbing pain all across my abdomen every time I have a
bowel movement. I am in excruciating pain when I stand to have a pee in my jug.
I have to hold on to the side of the shelf for support. Lately when I do have a
bowel movement I am bleeding from my bum hole afterwards.
Medical Report states and I quote:
"Diagnosed with a heart murmur aged 2 years
old."
This is completely false. I never said that at all. I
said I was diagnosed with a heart murmur
at 2 days old.
Medical Report states and I quote:
"Evidence reviewed includes the Questionnaire, previous
report, appointment letter, hospital correspondence and POID2, client pain
diary, emails and correspondence."
I would like to know if Mr Mohammed Naiwaz has been in
contact with either my GP or my specialist how come I have not been informed
about it. I would also like a copy of all of their conversation they have had
discussing my case. What is POID2?. What appointment letter is Mr Mohammed
Naiwaz referring to? I would like a copy of all emails and correspondence made
between Mr Mohammed Naiwaz and other third parties that has been involved with
my case.
Medical Report states and I quote:
"The main reason for leaving work was physical
health"
I did not have choice to leave work. The regional Manager
of the Bodycare I was working at said that she had to let me go due to my
physical health and because I have been on the sick for a whole year.
Medical Report states and I quote:
"She reports she is now sleeping well following her
operation. She no longer wakes up in pain"
This was true for the first month or so but sadly I am
now slowly going back to waking up in the night again. I am maybe waking up
once or twice a week at the moment but I feel like I am going back to the way I
was before the operation. I wake my partner up by a text as I cannot walk across
the landing to the other bedroom due to being in so much pain. My partner
always does my hot water bottle and emptied my pee jug. I am taking at least 2
lots of Tramadol and Paracetamol in the night before I am able to go back to
sleep. When I do go back to sleep I am still suffering in pain. There has been
a couple of times where I have woken up in the night and stayed awake for most
of the day as well as I cannot fall back to sleep due to excruciating pain I am
in. I do have to have a nap in the day time to try and catch up on the sleep I
have lost the night before.
Medical Report states and I quote:
"Her partner will wash and dress her child"
My partner looks after our son all day every day. He
takes him to school and picks him up. He cooks our son meals and make him
drinks. He baths our son every weekend. On the school days I do go downstairs
and dress my son for school but I am constantly sitting on the sofa while I am
dressing him and even then I am constantly suffering extreme pain and it does take
me some time to get him dressed. My partner has to stand at the sink with our
son and help him brush his teeth as I cannot stand at all in the mornings. My
partner always get our son dressed and ready for bed every night. My partner is
the one who mostly dress our son at the weekend. I sit with our son every night
and do his homework with him on the sofa but then I am straight back upstairs
resting in bed due to suffering pains while sitting on the sofa. It is very
rare I play with my son now because I always end up in pain straight after and
for days afterwards.
Medical Report states and I quote:
"She has been going out in the last 2 months
following her operation"
I did not say this. Since my operation back in June I
have probably been out at least 9 times all told and every time has either been
in my mother-in-law’s car or by a taxi. My partner thinks this slanderous.
Refer back to my pain diary. I have gave you the last 2
months of my pain diary. Dated from 1st October to 30th
November 2021. My pain diary details everything that I have mentioned in this
letter.

I definitely want a second opinion on all of my
documentation and reports that has been made by Mr Mohammed Naiwaz and any
other third parties that has been involved with my case. Both me and my partner
do believe that a lot of lies has been made here and it does need to be looked
into more probably.
I am still going by what my specialist said in one of her
letters by waiting till the 4 months is up before I need to speak to her again
which is on January 7th 2022 by a telephone conversation. We will be
asking her to be referred to whoever she thinks is the next best person to see.
